Part of the problem is that there is no easy way to identify infringement, therefore rendering copyright a complete mess. Imagine that there's some kind of "Content-ID" system as set up by Google: companies and producers need to upload their works to the Content-ID system, so the algorithm can identify if people upload the same material. But how to determine what's the "same"? A check for identical hashes doesn't work, because infringers will change one byte, so the algo has to look at the content. But then, infringers add noises to music, invert, rearrange, crop movies, etc., and then: how is an algo supposed to come to the same conclusion as a judge would when it comes to the question if it is covered by Fair Use or not? And mods: the more uploads, the more mods would be needed, all trustworthy and competent. How are they going to find out if the uploader obtained permission somehow? Still, there's hope: the community may keep the site clean, and smaller sites face less expectations.
